Terms and Conditions for Counselling Programmes

1. General Terms

1.1. Delivery of Services: 

Personal development counselling services are delivered online, via Zoom, based on a Personal Development Counselling Agreement containing the description of the purchased counselling programme, its conditions and the mutually agreed goal of the counselling process.

1.2. Payment of services: 

All payments are made through bank transfer or online card payments through Netopia-Payments secured payment platform, as chosen by the clients. All payments are made based on an invoice. 

  • Counselling programmes consisting of 5 or 10 sessions must be paid for after the second session and before the third. 
  • In the case of pay-as-you-go sessions, the first two sessions are paid after the first session, but before the second. The following sessions must be paid for at least 24 hours before the session takes place.
  • One-off sessions of 90 or 120 minutes must be paid for at least 24 hours before the session is scheduled.

1.3. Engaging in a counselling process: 

Before engaging in any counselling process, a free Clarity Call should take place between the potential client and the counsellor. The free 30-minute Clarity Call is available to anyone interested and can be booked through the Calendly booking page. 

Attending a Clarity Call does not imply any commitment from any of the parties involved. This call aims to uncover the present situation and the challenges the potential client faces, and provide information necessary for both parties to decide whether they want to engage in a facilitation programme together.

1.4. The right to cancel and withdraw from a programme:

1.4.1. Withdrawing from the Clarity Call: The potential client can withdraw by simply cancelling the appointment on the Calendly page.

1.4.2. Withdrawing after the Clarity Call: Based on the Clarity Call, the potential client can decide not to engage in a counselling process without providing any explanation. The Counsellor may decide not to work with the potential client and must provide a solid reason. 

1.4.3. Withdrawing from the counselling programme after the first session, in case of programmes that consist of several sessions: If the client decides she/he doesn't want to continue the programme based on the first session, has the right to withdraw without providing a reason. However, feedback on the motives is welcome for future service development. For this reason, all payments are requested after the first session, regardless of the counselling programme. 

In this case, the session is free of charge, and there is no payment requirement for it. For this reason, all payments are requested after the first session, regardless of the counselling programme. 

1.4.4. Right to withdraw in case of one-off sessions (only one session of 90 or 120 minutes): In case of a one-off session, the client can withdraw after the Clarity Call, if there is one, or 12 hours before the session takes place. Withdrawal is valid only if the client communicates her/his withdrawal intention via email. Otherwise, it is considered a no-show, and the session must be paid for. 
If payment was made and the withdrawal was communicated within the timeframe, the amount of money can be redirected toward another service, or will be paid back within a maximum of 5 working days.

2. Terms for terminating the counselling agreement and refunds

2.1. Earlier achievement of the counselling goal

If the Parties achieve the goal set in the Agreement in fewer sessions than agreed initially, the Client can use the remaining sessions to achieve other personal development goals or may decide to be refunded for the unused sessions. The average price per session will remain the original price per session of the purchased facilitation package.

2.2. Terminating the Counselling Agreement

Both the Client and the Counsellor can decide to stop the counselling programme at any time and terminate the Agreement based on the conditions set in the Agreement. 

2.2.1. The Client can terminate the agreement after the second session by announcing it in email or verbally at a session with one week's notice. In this case, no refund will be made for the already delivered sessions, and the price of the already consumed sessions is recalculated based on the average session price of a shorter programme (if 5 or more sessions were delivered) or at the price of a pay-as-you-go session in case of fewer than 5 sessions. The remaining amount will be refunded within a maximum of 5 working days.

2.2.2. The Counsellor can terminate the contract if the client 

  • presents repeated signs of unwillingness to change and to apply the learnt techniques into her/his life, or consistently ignores doing the agreed tasks and exercises between the sessions;
  • presents signs of a situation or condition that is outside the scope of personal development counselling and needs the involvement of another type of professional, such as a therapist, psychologist or psychiatrist. In such a case, the counsellor will suggest that the client consult such a professional before continuing the counselling process. 

If the counsellor terminates the programme, the client will be refunded the entire amount of money for the remaining sessions. No recalculation is applied.  

3. Terms for engaging in a new programme or the continuation of the programme

3.1. Continuation of the counselling process after the termination of the agreement

If the Client decides to continue the transformation journey after the contracted programme ends, the contract can be extended with additional sessions at the average session price of the initially purchased programme. This price applies to the new sessions even if they are paid on a pay-as-you-go basis.

3.2. Engaging in a new counselling agreement after the end of the programme

If the client engages in a new counselling agreement within 12 months from the end of the programme that had at least 5 sessions, they receive a 5% discount on the price of the chosen programme, or if prices have increased in the meantime, can contract a new programme at the original price. The most advantageous situation will be applied from the two possibilities.

4. Confidentiality

All information disclosed by the Client during the counselling process is confidential, and the Counsellor cannot disclose this information or use it as an example without the Client's prior consent.

5. Intellectual property

The Client agrees that any intellectual property provided to her by the Counsellor will remain the sole property of the Counsellor, and the Client will use it exclusively for her own development process and should not disclose any material to a third person without the permission of the Counsellor.

6. Disclaimer

The Counsellor uses her best competencies to support clients in achieving their goals. 

The Counsellor makes no guarantees or warranties of any kind, express or implied, concerning the results of the agreed programme, as the results also depend on the Client's sincerity, involvement, commitment, readiness to change and actions.
